Understanding the Role of a Justice of the Peace

A Justice of the Peace serves as the judge of the local Justice Court, often called the “people’s court.” This court handles legal matters that directly affect everyday life for individuals, families, and small businesses in Collin County.

Justice Courts hear a variety of civil cases, including small claims and debt disputes up to $20,000. These courts also preside over eviction cases and repair-and-remedy matters involving rental properties, which can have a significant impact on housing stability and tenant safety.

In addition to civil cases, a Justice of the Peace may handle certain fine-only Class C misdemeanor offenses, such as traffic violations and other minor offenses defined by Texas law. In some situations, the court may also hear specific juvenile-related cases as provided by statute.

Beyond the courtroom, Justices of the Peace perform important magistrate duties, including issuing warrants, setting bonds, and conducting inquests when required. These responsibilities help ensure the fair and orderly application of the law at the local level.

Because the Justice of the Peace serves the community closest to where people live and work, the role requires fairness, impartiality, and a strong understanding of both the law and the people it serves.
